1. Definitions

In these Terms and Conditions, the following definitions apply:

1.4 Waste means any items, materials or rubbish that you ask us to remove, collect or dispose of as part of the Services, subject to any exclusions set out in these Terms and Conditions.

2. Scope of Services

2.1 We provide waste collection and rubbish removal services in Camden and surrounding areas, including household, commercial and garden waste clearance, subject to availability and to these Terms and Conditions.

2.2 The specific nature and extent of the Services to be provided will be agreed at the time of booking, based on the information you give us about the type and volume of waste, access to the property and any special requirements.

2.3 We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, prohibited, incorrectly described, or not as agreed at the time of booking.

3. Booking Process

3.1 You can request a booking for our rubbish removal and waste collection services by telephone, email or through our online enquiry channels where available.

3.2 At the time of booking you must provide accurate and complete information, including:

(a) your name, contact details and collection address;
(b) a description and approximate quantity or volume of the waste;
(c) any access issues, parking restrictions or time limits that may affect the collection;
(d) any items that may require special handling.

3.3 We may provide an initial quotation based on the information you supply. This quotation is subject to change upon arrival if the volume, type or location of the waste is different from what was described.

3.4 Your booking is not confirmed until we have accepted it and, where required, received a deposit or payment details. We reserve the right to decline any booking at our discretion.

3.5 We will use reasonable efforts to attend at the agreed date and time, but arrival times are estimates only and may be affected by traffic, delays, weather or other factors beyond our control.

4. Waste Volume, Estimates and Changes on Arrival

4.1 All quotations for rubbish removal and waste collection are based on the information you provide about the waste volume, type and access.

4.2 On arrival, our team will assess the waste and confirm the final price based on actual volume, weight, type of items and the time required to complete the clearance.

4.3 If the waste is substantially more than described, or if access is significantly more difficult than stated at the time of booking, we may:

(a) revise the price;
(b) limit the collection to the volume covered by the original quotation; or
(c) decline the job if it cannot be safely or lawfully completed.

4.4 If we need to revise the price, we will explain the reasons and obtain your agreement before proceeding. If you do not agree, we will not be obliged to carry out the Services and may charge a call-out or cancellation fee where applicable.

5. Payments and Charges

5.1 Our standard charges are based on factors such as volume or weight of waste, type of items removed, labour required, and any disposal or recycling costs.

5.2 We may require full or partial payment in advance, or payment on completion of the collection, depending on the nature of the booking and the Customer profile.

5.3 Payment must be made in cleared funds by cash, card or other methods that we may make available from time to time. We do not accept cheques unless agreed in writing prior to the visit.

5.4 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Where applicable, taxes will be added at the prevailing rate.

5.5 If you fail to make any payment when due, we may:

(a) charge interest on overdue amounts at the statutory rate;
(b) withhold or suspend further Services until payment is received;
(c) recover from you any reasonable costs we incur in enforcing payment.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking subject to the following conditions.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged, unless otherwise stated at the time of booking.

6.3 If you cancel less than 24 hours before the scheduled collection time, we reserve the right to charge a late cancellation fee to cover our administrative and scheduling costs.

6.4 If our team arrives at the collection address and is unable to complete the job due to:

(a) your failure to be present or provide access;
(b) incorrect or incomplete address details;
(c) the waste not being as described and you refusing any revised quotation; or
(d) health and safety risks beyond what was disclosed,

we may treat the booking as cancelled by you on short notice and charge a call-out or cancellation fee.

6.5 We reserve the right to cancel or reschedule a booking due to circumstances beyond our control, including but not limited to severe weather, vehicle breakdown, staff illness or regulatory restrictions. In such cases we will notify you as soon as reasonably possible and offer an alternative date or a refund of any amounts paid for Services not provided.

7. Customer Responsibilities

7.1 You are responsible for ensuring that:

(a) access to the property and the waste is safe and unobstructed;
(b) any necessary permissions for parking and access are obtained in advance;
(c) waste is clearly identified and separated where required (for example, separating recyclable materials or hazardous items where appropriate);
(d) the information you provide about the waste is accurate and complete.

7.2 You must not include in the waste any items that are hazardous or prohibited, such as asbestos, certain chemicals, gas cylinders, medical waste, explosives, or any material which we are not licensed or equipped to handle.

7.3 You must comply with all reasonable instructions from our staff to ensure safe and efficient carrying out of the Services.

8. Waste Regulations and Compliance

8.1 We operate in accordance with applicable UK waste management laws and regulations, including duty of care requirements for the transport, handling and disposal of controlled waste.

8.2 We will transport and dispose of collected rubbish only at authorised facilities and will take reasonable steps to maximise reuse and recycling where practicable.

8.3 We may refuse to collect any waste that we believe to be unlawful, hazardous, incorrectly classified, or otherwise in breach of relevant waste regulations.

8.4 Once the waste has been loaded onto our vehicle and payment has been made or agreed, title to the waste transfers to us and we become responsible for its lawful transport and disposal.

9. Parking, Access and Permits

9.1 You are responsible for providing suitable parking and access for our vehicles and removal teams, including any permits required for parking or access restrictions.

9.2 Where parking charges apply, these may be added to your final bill if they are incurred directly in connection with the provision of the Services.

9.3 If our team is unable to park or access the property safely and lawfully, we may be unable to complete the Services and may charge a call-out or cancellation fee.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing our rubbish removal and waste collection services.

10.2 We shall not be liable for any indirect, consequential or economic loss, including loss of profits, revenue, reputation or business opportunity, arising from or in connection with the provision of the Services.

10.3 Our liability for direct loss or damage to your property caused by our negligence shall be limited to the reasonable cost of repair or replacement of the damaged item, up to a maximum aggregate amount equal to the total fees paid or payable for the specific job in respect of which the claim arises.

10.4 We shall not be responsible for pre-existing damage, wear and tear, structural defects or latent issues with your property that are revealed or exacerbated during the provision of the Services.

10.5 You must notify us in writing of any claim for loss or damage as soon as reasonably practicable and in any event within 7 days of the relevant collection, providing full details and any supporting evidence.

10.6 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Insurance

11.1 We maintain appropriate insurance cover in relation to our rubbish removal and waste collection activities, including public liability insurance, subject to the terms, exclusions and limits of the relevant policies.

11.2 Details of our insurance cover are available on request.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing your name, contact details, job reference (if any) and a description of the issue.

12.2 We will investigate your complaint and aim to respond within a reasonable period with our findings and any proposed resolution.

12.3 If a dispute arises that cannot be resolved through our internal complaints process, both parties agree to attempt in good faith to resolve the matter through informal negotiation before considering legal proceedings.

13. Force Majeure

13.1 We shall not be liable for any delay or failure to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, accidents, acts of government or regulatory bodies, traffic disruptions, strikes, or interruptions in utilities or transport networks.

14. Data Protection and Privacy

14.1 We will collect and process personal information about you only to the extent necessary to manage bookings, deliver services, process payments and handle queries or complaints.

14.2 We will handle your personal data in accordance with applicable data protection laws in the UK and will take reasonable steps to protect it from unauthorised access, misuse or disclosure.

15. Variations to these Terms

15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, pricing, operations or applicable law.

15.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time you make the booking, unless we notify you of a change and you expressly agree to be bound by the updated version.

16. Severability

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable or, if that is not possible, deleted. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between you and us in relation to the Services and supersede any previous agreements, understandings or representations, whether written or oral.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish removal and waste collection services.
